Use of www.BestClinicsIstanbul.com (“Site”) and use of our BEST CLINICS ISTANBUL services (the “Services”) are governed by these Terms and Conditions (“Agreement”).  

By using or accessing the Site, the users of the Site (“Users”) agree to be bound by this Agreement (and the Users who are using the Site on behalf of a third party agree that in doing so, they are authorized to bind the relevant person) to (i) use the Site (A) only in compliance with this Agreement and any applicable laws, (B) for non-commercial purposes and (ii) to act reasonably and in good faith at all times when using or accessing the Site.

BEST CLINICS ISTANBUL may revise and update this Agreement at any time without notice. The Users’ continued usage of the Site will mean that you accept those changes.

Any use or reliance on any Content (as defined below) or data obtained by you through the Services is at your sole own risk. BEST CLINICS ISTANBUL cannot guarantee the accuracy of the Content on the Site or its relevance, adequacy or sufficiency for the Users’ purposes. Ceasing to use the Site shall constitute the sole and exclusive remedy for dissatisfaction with the Services, the Site and its Content (as such terms are defined below).

The Users release BEST CLINICS ISTANBUL from all liability for the Users having visited the Site.

​BEST CLINICS ISTANBUL provides informative content about medical facilities in Istanbul (Turkey) (“Medical Service Providers”) and importantly, it does not provide medical services or advice itself to the Users. The Services are therefore provided as a database only, and the data included in the Site is intended as a reference guide only to the Users, and should not be used by the Users or any other person as a substitute for professional medical advice. 

BEST CLINICS ISTANBUL discloses details and information on Medical Service Providers based on data, either directly provided by the Medical Service Providers or collected from a variety of publicly available sources (“Content”). The Content has not been independently verified by BEST CLINICS ISTANBUL. BEST CLINICS ISTANBUL accept no liability to any person (including but not limited to any User) for any action taken based upon the use of the Site (including without limitation the Users’ use of the Content and the receipt of the Services).

By including certain Medical Service Providers on the Site, BEST CLINICS ISTANBUL, does not recommend, endorse or guarantee any of them specifically.

BEST CLINICS ISTANBUL does not assume any rights, obligations or liabilities in respect of the relationship that Users may develop with Medical Services Providers. 

BEST CLINICS ISTANBUL advises Users to always seek the advice of a qualified healthcare provider with respect to any questions regarding medical health as the Content (including the information provided by the Medical Service Providers) cannot replace such advice. 

The Medical Service Providers included in the Site are solely responsible for (i) all pre-treatments, treatments and post-treatments provided to patients (regardless of whether these patients are or were at any time Users) including any direct or indirect consequences that these may have on such patients or any third party (such as side effects and possible complications), as well as (ii) on-boarding of such patients, all related queries, discussions and opinions. BEST CLINICS ISTANBUL are not responsible for these, nor for the avoidance of doubt for any emergency, complication, or a medical requirement of any nature.

The use of the Site does not create a doctor-patient relationship between BEST CLINICS ISTANBUL and the Users, nor any other type of relationship (including, without limitation any employee/employer contractual relationship, any consultancy or agency types of contractual relationships).

The Services that BEST CLINICS ISTANBUL provides may change from time to time, partially or entirely cease to be provided without prior notice to you. 

The Users hereby agree to the extent permitted by law to indemnify and hold harmless (on an after tax basis) BEST CLINICS ISTANBUL and its officers (including directors and any other representatives), consultants, employee, agents, from and against any losses, taxes, claims, disputes, demands, liabilities, damages of any nature or kind, costs and expenses, including, without limitation, reasonable legal fees (including any value added tax arising thereon) arising out of, by reference or in connection with (i) the Users’ access to or use of the Site and the Content (including, for the avoidance of doubt the receipt of the Services), whether such access or use is permitted under this Agreement or not; (ii) the data you provide BEST CLINICS ISTANBUL or the Medical Service Providers; or (iii) relating in any way to this Agreement (including for the avoidance of doubt a breach of this Agreement).

These Terms and Conditions and any legal action related thereto will be governed by the laws of Dubai (United Arab Emirates).

All disputes will be resolved exclusively by a court in Dubai provided that arbitration proceedings may be used in preference to court proceedings, at BEST CLINICS ISTANBUL’s behest.

If any of the terms or conditions contained herein are invalid or unenforceable under applicable law, the remaining provisions shall continue in full force and effect, and the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision.

The Terms and Conditions are the entire and exclusive agreement between BEST CLINICS ISTANBUL and the Users regarding the Services and the use of the Site and Content in connection therewith.

Any claims that Users or a third party may have relating to the Site must be brought to the attention of BEST CLINICS ISTANBUL through the contact form. 

BEST CLINICS ISTANBUL’s failure to act with respect to a breach of this Agreement by any User or others does not constitute a waiver of BEST CLINICS ISTANBUL’s right to act with respect to subsequent or similar breaches.

Users may download and reprint a single copy of Content from the Site for User’s personal, non-commercial use only, provided the Users include all applicable notices and disclaimers. Any other use of the materials is strictly prohibited without our prior written permission and the permission of BEST CLINICS ISTANBUL or the applicable rights holder(s).
